Regulations on the endowment capital of permanent establishments of international banks

This article addresses September 2004 Regulations by the German federal Ministry of Finance as to the endowment capital (allocable equity) of the German permanent establishments of foreign banks and the foreign permanent establishments of German banks. The content and impact of the Regulations are discussed and the question of the viability of the Regulations within the context of domestic and international tax law is discussed.
