Tariff Measures between Ecuador and Colombia: Implications for Transfer Pricing and Cross-Border Transactions

Geopolitical decisions can significantly affect not only governments and public policy but also multinational business operations. This article analyses the transfer pricing implications of the tariff measures adopted in the context of the recent trade tensions between Ecuador and Colombia. It examines how customs-related measures may disrupt supply chains, increase landed costs, affect operating margins and require multinational groups to reassess their intercompany pricing policies. Particular attention is given to the allocation of risk, the selection of the tested party, comparability adjustments, customs valuation issues and the documentation required to support arm’s length outcomes. The article argues that tariff shocks should not be treated merely as customs costs, but as events capable of materially affecting the economic substance of cross-border related-party transactions.
